A short sale is a transaction in which the lender, or lenders, agree to accept less than the mortgage amount owed by the current homeowner.  In some cases, the difference is forgiven by the lender, and in others the homeowner must make arrangements with the lender to settle the remainder of the debt.

Due to the recent economic crisis, including rising unemployment and drops in home prices in communities across the nation, the number of short sales is increasing. Since a short sale generally costs the lender less than a foreclosure, it can be a viable way for a lender to minimize its losses.  A short sale can also be the best option for homeowners who are “upside down” on mortgages because a short sale may not hurt their credit history as much as a foreclosure.  As a result, homeowners may qualify for another mortgage sooner once they get back on their feet financially.

The Federal Housing Administration (FHA) announced January 20, 2010, that it is implementing more stringent lending requirements and higher borrower fees to cushion against rising defaults and stave off the need for a taxpayer bailout of the agency.  The FHA said it will raise insurance fees that borrowers must pay, and it will cap the amount of cash that sellers can contribute for closing costs.  It will also require higher down payments for borrowers with poor credit scores, below 580.  Starting this summer, borrowers with credit scores below 580 will be required to make a minimum 10% down.  While the FHA doesn’t have a credit-score cutoff, most lenders require a minimum 620 score.  Fewer than 1% of FHA borrowers last year had credit scores below 580, according to LPS Applied Analytics.

LEASED!

If you’re building a new home, some limits apply to your ability to obtain a tax credit under the American Recovery and Reinvestment Act (ARRA) of 2009.  You can qualify for the tax credit for geothermal heat pumps, photovoltaics, solar water heaters, small wind systems and fuel cells, but not the tax credit for windows, doors, insulation, roofs, HVAC, or non-solar water heaters.

To better understand what qualifies, here are some definitions:

  • Bio-mass Stoves – stoves fueled with organic materials such as wood pellets, corn, dried cherry pits, soybeans and nutshells
  • Photovoltaics - solar cells that convert sunlight directly into electricity
  • Geothermal Heat Pumps - apparatus that draws natural heat from the ground or from a body of water, and then forces it into a building
  • Small Wind Energy Systems  - electric generators that utilize wind energy to produce clean, emissions-free power for individual homes, farms, and small businesses
  • Fuel Cells – cells that generate electricity and hot water when oxygen reacts chemically with hydrogen that has been extracted from natural gas and other fuels

If you’re thinking about energy-efficient home improvements, now may be the time to take action!

To encourage homeowners to invest in these projects, the Federal government  will allow you to claim a 30% tax credit (up from 10%) for purchases made in 2009 and 2010 of the following items:

  • Windows/Skylights

  • Doors

  • Insulation

  • Roofs (metal and asphalt)

  • HVAC

  • Water Heaters

  • Bio-mass Stoves

If you’re planning to put your house on the market, these are exactly the kinds of improvements that buyers are looking for – new furnaces, doors and windows will always make your home more attractive and competitive!

Some details:

  •  Maximum credit per household is $1500*
  •  Improvement must be placed in service from January 1, 2009 through December 31, 2010
  •  In taxpayer’s principal residence
  •  Claim improvements made in 2009 on your 2009 income tax return (filed by April 15, 2010)

*Broader rules apply to geothermal heat pumps, solar water heaters, solar panels, fuel cells, and windmills.  These are not subject to the cap, and are in effect through 2016.  Plus, they apply to more than just your principal residence – rental units, second homes, etc.
